Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Thunderstruck mobile application (the "Service") operated by us.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms.
1. ELIGIBILITY
You must be at least 18 years of age to create an account on Thunderstruck and use the Service. By creating an account, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement.
2. USER CONDUCT
You agree not to use the Service to:
- Post or share content that is illegal, abusive, harassing, hateful, defamatory, or otherwise objectionable.
- Impersonate any person or entity.
- Use the Service for any commercial purpose.
- Violate any applicable local, state, national, or international law.
We reserve the right to investigate and/or terminate your account without a refund if you have violated this Agreement.
3. THE "THUNDERSTORM" AND COMMITMENT FEE
The Service's core feature is a timed chat with a match ("Thunderstorm"). At the conclusion of the Thunderstorm, you will be given the option to pay a one-time "Commitment Fee" to continue the conversation in an exclusive mode.
By paying this fee, you agree that you are making a non-refundable purchase. This fee grants you and your match exclusive access to each other within the App. This means you will not be shown in the "Scryfall" to other users, nor will you see other users' Sparks, for as long as your exclusive chat is active.
4. ACCOUNT TERMINATION
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
You may terminate your account at any time by accessing your account settings.
5. DISCLAIMERS
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the operation of the Service or the information, content, or materials included therein. We do not warrant that the app will be uninterrupted or error-free.
6. LIMITATION OF LIABILITY
In no event shall Thunderstruck, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
